NEWS DIGEST– Nigerian Afrobeats singer, Abdulazeez Fashola, popularly known as Naira Marley, and Lagos socialite, Samson Eletu, also known as Sam Larry, have taken legal action by filing a basic rights lawsuit to contest their extended detention related to the death of Ilerioluwa Aloba, also known as Mohbad. 

The lawsuit, which was submitted to the Federal High Court in Lagos, lists the Police and Lagos magistrate, Adeola Olatunbosun, as defendants. The duo is seeking N20 million in damages from the accused.

According to the lawsuit filed through their lawyer, Olalekan Ojo (SAN), Naira Marley and Sam Larry claim that their rights were violated due to their prolonged incarceration at the Homicide Section of the Lagos State Police Command since October 4, 2023. They are requesting the court to rule in their favor and order their immediate release.

The affidavits attached to their claims state that their troubles began on October 3 and 4, 2023, when they were arrested by the police on suspicion of involvement in the death of Ilerioluwa Aloba. Subsequently, on October 4, 2023, the Commissioner of Police sought a 30-day remand order in the Yaba Magistrates’ Court. 

However, Chief Magistrate Adeola Olatunbosun approved a 21-day remand in police custody. As of October 26, 2023, the 21-day remand order has expired, and it has not been renewed.

Naira Marley and Sam Larry are hopeful that their lawsuit will bring about the desired outcome and justice for their prolonged detention in relation to the death case.

“At the Homicide Section of the Lagos State Police Command, Panti, Yaba, Lagos State since October 4, 2023,” according to the lawsuit they filed through Olalekan Ojo (SAN).

They are also asking for “a court order releasing the applicants forthwith” .

“Their travails started between October 3 and 4, 2023 when they were arrested by the police on the alleged connection of the applicants with the death of one Ilerioluwa Aloba, aka Mohbad,” the deponents stated in the affidavits attached to their claims.

“On October 4, 2023, the Commissioner of Police requested a 30-day remand order in the Yaba Magistrates’ Court.

“Chief Magistrate Adeola Olatunbosun approved the police’s request to remand them for a mere 21 days in police custody.”Since then, Chief Magistrate Olatunbosun’s 21-day remand order has expired on October 26, 2023, and it has not been extended.
