The Court of Appeal in Abuja has dismissed the ex parte order issued by the Rivers State High Court on May 10, 2024, which had barred Martin Amaewhule from acting as the Speaker of the Rivers State House of Assembly.

The appellate court also overturned the decision of the state high court that had prohibited 24 other Assembly members from accessing the legislative complex or performing any legislative duties in the name of the Rivers State House of Assembly.

A three-judge panel, led by Justice Jimi Olukayode-Bada, delivered the judgment, upholding the appeal filed by Martin Amaewhule and the 24 other Assembly members against Speaker Victor Oko-Jumbo and two others.

In its ruling, the court addressed the jurisdictional authority, stating that only the Federal High Court has the exclusive and mandatory jurisdiction to hear and grant such ex parte orders, as per Section 273 of the Constitution.
